Obama to fill two NLRB seats
President Obama announced March 27 his intent to make 15 recess appointments including two to the National Labor Relations Board, reports The New York Times.

The Constitution permits the president unilaterally to make appointments when the Senate is not in session.

Because of an "unprecedented level" of Republican obstruction, these nominees have been pending in the Senate for an average of 214 days, or seven months, according to the White House.

"The United States Senate has the responsibility to approve or disapprove of my nominees. But if, in the interest of scoring political points, Republicans in the Senate refuse to exercise that responsibility, I must act in the interest of the American people and exercise my authority to fill these positions on an interim basis," said Obama in a statement.

"Most of the men and women whose appointments I am announcing were approved by Senate committees months ago, yet still await a vote of the Senate.

Obama's list of recess appointees includes two to the National Labor Relations Board Craig Becker and Mark Pearce:

Craig Becker currently serves as associate general counsel to both the Service Employees International Union and the AFL-CIO.

He graduated summa cum laude from Yale College in 1978 and received his J.D. in 1981 from Yale Law School where he was an editor of the Yale Law Journal. After law school he clerked for the Honorable Donald P. Lay, chief judge of the United States Court of Appeals for the Eighth Circuit.

For the past 27 years, he has practiced and taught labor law at UCLA, the University of Chicago and Georgetown University. He has published numerous articles on labor and employment law in scholarly journals, including the Harvard Law Review and Chicago Law Review, and has argued labor and employment cases in virtually every federal court of appeals and before the United States Supreme Court.

Mark Gaston Pearce has been a labor lawyer for his entire career. He is one of the founding partners of the Buffalo, N.Y. firm of Creighton, Pearce, Johnsen & Giroux where he practices union-side labor and employment law before state and federal courts and agencies, including the N.Y.S. Public Employment Relations Board, Equal Employment Opportunity Commission, the U.S. Department of Labor, and the National Labor Relations Board.

In 2008, Pearce was appointed by the governor to serve on the New York State Industrial Board of Appeals, an independent quasi-judicial agency responsible for review of certain rulings and compliance orders of the state Department of Labor in matters including wage and hour law.

Pearce has taught several courses in the labor studies program at Cornell University's School of Industrial Labor Relations Extension. He earned his J.D. from State University of New York, and his B.A. from Cornell.

Teamsters applaud appointment of Becker, Pearce to NLRB

(The International Brotherhood of Teamsters issued the following on March 29, 2010.)

WASHINGTON, D.C. Teamsters General President Jim Hoffa today praised President Obama for appointing Craig Becker and Mark Pearce to the National Labor Relations Board.

Hoffa said both men are extremely well-qualified for the positions, which have been vacant for more than two years.

Were thankful that the President appointed two men who will work to restore fairness in the workplace, Hoffa said.

Craig Becker is a good and decent man. He has earned a reputation for impartiality over a long and distinguished career. His views are well within the mainstream of labor law. It shouldnt be forgotten that seven of the past eight NLRB members have been recess appointments, Hoffa said.

Hoffa noted that because there have been only two members of the NLRB one Democrat, one Republican the board hasnt been able to resolve many issues important to both management and labor. Hundreds of important labor cases that deserve to be heard are not being resolved.

Its time for the NLRB to get on with its important work, Hoffa said. By appointing Craig Becker and Mark Pearce, President Obama will allow the board to finally move forward.

Founded in 1903, the Teamsters Union represents more than 1.4 million hardworking men and women in the United States, Canada and Puerto Rico.
