Ohio woman says husband died because of railroad jobs

(The following story by Cara Bailey appeared on the West Virginia Record website on August 28.)

CHARLESTON, W.Va. The widow of a man who worked more than 27 years in the railroad industry has filed a suit claiming her husband died from exposure to deadly dusts on the job.

Ruth E. Davis, an Ohio resident, filed the suit July 25, in Kanawha Circuit Court, on behalf of her late husband, John E. Davis.

The suit names CSX Transportation and Consolidated Rail Corporation as defendants.

John Davis worked as a machinist for Consolidated Rail from 1964 to 1976, and at CSX from 1977 to 1992. During his employment, he was allegedly exposed to toxic substances, including asbestos, diesel exhaust and chemicals, which caused him to develop lung cancer.

Ruth Davis claims her husband was not warned of the dangers associated with working around the deadly toxins.

In the three-count suit, Davis seeks all damages allowed under the Federal Employee Liability Act for her husband's estate.
