FRA Emergency Order 26 as it pertains to BNSF Locomotive Engineers in Freight Service
As BNSF Engineers, none of us has any Railroad supplied cell phones or devices so I won't address rules regulating our use of them.
When the train is moving, your cell phone must be off and ear piece removed.
When you are stopped your cell phone must be off and ear piece removed if a crewmember is on the ground, if a utility is attached, if another crew is assisting you, if a carman or hostler is working your train or consist, or if you are being Ops tested.
You may not listen to music, play games, watch video or TV, word process or surf the Internet while on duty.
You can use your cell phone in an emergency.
You can use your cell phone if radio communication fails but you have to be stopped.
A crewmember can use a Hammerhead as long as you agree it is safe for them to do so.
You can look up a rule on your cell phone, PDA or laptop, etc., as long as you are stopped.
In short, except for an emergency, the only time you can use your cell is when you are stopped, no one is attached, working, or ops testing your train, your crewmembers are in the cab, and it doesn't interfere with your other duties.
Unless your conductor has a BNSF supplied cell phone, these rules also apply to him.
Beware that BNSF might alter their rules in the near future.

Not overtly......... but we can always tell......... when an ops team is in the area the birds stop singing, all the flowers start to wilt, and the sun retreats behind a cloud......!!

Deadly sin, gluttony. As for cellphones, well, I guess you call the dispatcher and ask him if any testing is going on in the area. Or look out and see if the sky has turned black.
I saw one walking around with that phaggy blue left turn blinker on yesterday.
Last time he got caught walking in the yard talking on the thing, they gave him a break and wrote it up as an earplug violation. He still argued that it was in his ear and should be considered hearing protection.
