DOT to implement "strip search" drug-test rule
WASHINGTON - Despite pleas from the UTU, other labor organizations and the BNSF, the Department of Transportation reports it will soon implement a rule that subjects rail and transit workers to a strip search during mandatory drug testing.

The requirement will become effective on Nov. 1.

The DOT will now require direct observation of urine specimen collection in all cases involving a return-to-duty test following a positive drug test and a follow-up test after a positive drug test.

This rule had been scheduled to take effect Aug. 25. Under current rules, a rail carrier has the discretion to require direct observation during an individual return-to-duty or follow-up test, but is not required to do so. This discretion will be replaced by the mandatory-observation mandate on Nov. 1.

The rule requires a "strip search" in all instances of direct observation. Specifically, railroads must "request the employee to raise his or her shirt, blouse, or dress/skirt, as appropriate, above the waist; and lower clothing and underpants to show, by turning around, that they do not have a prosthetic device [that could be used to deliver a substituted urine specimen]," DOT said.

After the railroad has "determined that the employee does not have such a device, [it] may permit the employee to return clothing to its proper position for observed urination," according to the rule

In August, the UTU, seven other rail unions and the BNSF Railway, filed a challenge of both the strip search and the mandatory direct observation provisions on constitutional and statutory grounds.

The unions succeeded in obtaining a delay in enforcement of the regulation to Nov. 1, arguing that the rule violates the Fourth Amendment of the U.S. Constitution, which protects citizens from unreasonable searches. The case has been docketed and the parties are awaiting their day in court.

Police Charge Man With Theft Of Women's Underwear

ELLICOTT CITY, Md. (CBS) A bizarre case unfolded in Howard County, Md.. where police say a man was breaking into apartments and stealing women's underwear.

It was at an apartment complex on Town and Country Road where Howard County Police say Brian Hong, 23, broke into at least nine apartments.

"Members of the community were very concerned because not only were things like jewelry, cash and laptops being taken, but clearly this man was going into private bedrooms of these women and stealing very private items," said Sherry Llewellyn, Howard County Police spokesperson.

Police say in many cases, entire underwear drawers were cleaned out.

"Very intrusive, and it is just very disgusting. How else would a woman put it? It's just private, and they don't need anyone stealing it," said Susan Kelley.

In at least two cases, victims reported seeing Hong peeping through windows.  In another case, police believe he stole a car after breaking in.

"There are concerns that perhaps this could have escalated to greater things, more serious things," said Llewellyn.

Detectives discovered Hong using a victim's credit card at a Howard County Exxon station.  Police caught up with Hong and arrested him in Elkridge. They obtained a search warrant for his home where they uncovered many stolen items.

Questions were raised as to whether his victims were targeted.

"We understand that he had familiarity with this apartment complex. He knew some of the people there. That's why he was continually drawn back to that location. We don't believe any one woman was targeted, but clearly he went to places where he would find items inside," said Llewellyn.

"Walking the dog and stuff makes you wonder who is really in the neighborhood and what kind of creep would do that," said Kelley.

Hong faces several charges including burglary, theft, car theft and two counts of peeping Tom.

UTU seeks further delay of drug-test rule

OCT. 31, NOON UPDATE: The D.C. Circuit Court of Appeals has issued an administrative stay of DOT's new strip-search drug-testing rule.

This means DOT may not force implementation of the rule -- scheduled for Nov. 1 -- until the court has sufficient time to study pleadings and determine whether to invoke the delay requested by the UTU, others in rail labor and BNSF Railway.

That delay, if granted, would halt implementation of the rule until the court determines whether it is contitutional to require strip searches as part of a drug test.

WASHINGTON, D.C. -- The UTU, other rail unions and BNSF Railway have asked a federal court in Washington, D.C., to order the U.S. Department of Transportation to delay implementation of a scheduled Nov. 1 order requiring rail and transit workers to be strip searched during mandatory drug testing.

 

The Bush administration's DOT earlier declined a similar delay request by rail labor, which asked that the new rule not be implemented until a federal court rules on whether such strip searching as part of a mandatory drug test violates the Constitutions prohibition against unreasonable searches.

When DOT declined, the UTU and the others went to the courthouse seeking a judicial delay pending a ruling on the constitutional question.

 

As previously reported, DOT wants to require direct observation of urine specimen collection in all cases involving a return-to-duty test following a positive drug test and a follow-up test after a positive drug test.

 

This rule initially had been scheduled to take effect Aug. 25, but DOT voluntarily delayed implementation until Nov. 1. The UTU and other rail labor organizations then asked a federal court to rule on the constitutionality of the rule. That ruling is pending.

 

Under current rules, a rail carrier has the discretion to require direct observation during an individual return-to-duty or follow-up test, but is not required to do so. This discretion was replaced by the mandatory-observation mandate, now scheduled for Nov. 1 implementation, unless further delayed by the federal court, or ruled unconstitutional.

 

The rule requires a strip search in all instances of direct observation.
