ELM GROVE, Wis. -- A couple who was ticketed following a crash at a suburban Milwaukee train crossing both say it's the railroad's fault, according to radio station WTAQ.
Monica Ensley-Partenfelder and Scott Partenfelder of West Allis have filed a civil suit against the Canadian Pacific Railroad.
A train came through Elm Grove the morning of last year's Memorial Day parade. Monica had stopped her vehicle on the tracks -- and her husband and Elm Grove officer John Krahn saved her just before the train hit the van.
Scott Partenfelder and Krahn were injured, and the couple's 2-year-old son was unharmed in a car seat.
The couple's lawyer, Victor Harding, says Scott Partenfelder's medical bills are over a half-million dollars and the railroad should pay them.
Harding said the railroad knew there was a parade that day with more traffic -- and it should have taken steps to prevent such a mishap.
The railroad has not commented.
Monica Ensley-Partenfelder was fined $63 for stopping on the tracks. Scott was fined $36 for driving with a license that was revoked in 1994.
