UP ordered to pay back wages to injured workerEUGENE, Ore. -- The U.S. Department of Labor's Occupational Safety and Health Administration has ordered Union Pacific Railroad Co. in Eugene to pay back wages and punitive damages to an employee who was fired after reporting a work-related injury, The Statesman Journal reported._ OSHA found that the railroad fired the worker in violation of the whistleblower protection provisions of the Federal Railroad Safety Act .The employee reported a work-related injury. OSHA officials said the employee's treatment plan included work restrictions, but the railroad assigned the employee tasks outside the physician's treatment plan.In turn, that forced the employee to take a medical disability leave. _The railroad subsequently issued a disciplinary letter and terminated the employee, OSHA said.(The preceding report by Michael Rose was published September 3, 2010, by the Statesman Journal.)
