SOMERVILLE, Texas -- Same song, slightly different dance in Somerville, as a second lawsuit against the Burlington Northern Santa Fe Railway Company gets underway, television station KBTX reports.
Jury selection in Dennis Davis' suit begins Monday morning. A longtime worker at the Somerville railroad tie plant, Davis claims BNSF did not take proper steps to protect workers from exposure to hazardous materials, causing him and others to develop cancer.
The trial was actually pushed back because Davis was undergoing cancer treatment.
In the first of many cases filed against BNSF, a jury ruled the company should not be held responsible for Somerville resident Linda Faust's stomach cancer.
Opening statements will likely come later this week.
