A New Jersey jury recently awarded $52.4 million to the family of a Consolidated Rail Corp. employee brutally killed in a train accident. Anthony Scarpello, 54, died in January 1999 when Van Ransdell, a fellow employee, accidentally backed a Conrail train into him. The train dragged Scarpello several feet before eventually cutting him in half. The family sued the company under the Federal Employees Liability Act, claiming Consolidated Rail was responsible for its employees' negligence. The plaintiffs insisted Ransdell had been working too many hours with inadequate rest periods at the time of the accident.
