Sheriff: US woman sat on boyfriend's toilet for 2 years; didn't want to leave bathroom

WICHITA, Kansas - Deputies say a woman in western Kansas became stuck on her boyfriend's toilet after sitting on it for two years.

Ness County Sheriff Bryan Whipple said it appeared the 35-year-old woman's skin had grown around the seat. She initially refused emergency medical services but was finally convinced by responders and her boyfriend that she needed to be checked out at a hospital.

"We pried the toilet seat off with a pry bar and the seat went with her to the hospital," Whipple said. "The hospital removed it."

Whipple said investigators planned to present their report Wednesday to the county attorney, who will determine whether any charges should be filed against the woman's 36-year-old boyfriend.

"She was not glued. She was not tied. She was just physically stuck by her body," Whipple said. "It is hard to imagine. ... I still have a hard time imagining it myself."

He told investigators he brought his girlfriend food and water, and asked her every day to come out of the bathroom.

"And her reply would be, `Maybe tomorrow,'" Whipple said. "According to him, she did not want to leave the bathroom."

The house had another bathroom he could use.

The boyfriend called police on Feb. 27 to report that "there was something wrong with his girlfriend," Whipple said, adding that he never explained why it took him two years to call.

Police found the clothed woman sitting on the toilet, her sweat pants down to her mid-thigh. She was "somewhat disoriented," and her legs looked like they had atrophied, Whipple said.

"She said that she didn't need any help, that she was OK and did not want to leave," he said.

She was taken to a hospital in Wichita, about 150 miles (240 kilometers) southeast of their home in Ness City. She was listed in fair condition. Whipple said she has refused to cooperate with medical providers or law enforcement investigators.

Authorities said they did not know if she was mentally or physically disabled.

Police have declined to release the couple's names, but the house where authorities say the incident happened is listed in public records as the residence of Kory McFarren. No one answered his home phone number.

The case has been the buzz of Ness City, said James Ellis, a neighbor.

"I don't think anybody can make any sense out of it," he said.

Ellis said he had known the woman since she was a child but that he had not seen her for at least six years.

He said she had a tough childhood after her mother died at a young age and apparently was usually kept inside the house as she grew up. At one time the woman worked for a long-term care facility, he said, but he did not know what kind of work she did there.

"It really doesn't surprise me," Ellis said of the bathroom incident. "What surprises me is somebody wasn't called in a bit earlier."

The bill would require anyone who contributes to a website to register their real name, address and e-mail address with that site, according to press reports. Their full name would be used anytime a comment is posted.

A Web site owner would have to pay a fine if someone posted anonymously on their site, if the bill were to become law. A first-offense fine would be five-hundred dollars. The Web site owner would have to pay one-thousand dollars for each offense after that.

Couch said he hopes to cut down online bullying.

Lawmaker's attempt to criminalize anonymous posting doomed

Kentucky lawmaker Tim Couch has proposed a bill that would criminalize anonymous Internet posting. Web site and forum operators would be forced to collect and publicly disclose identifying information about all of the visitors who post content on their sites. Failing to do so would lead to a fine of $500 for the first offense and $1,000 for each subsequent offense.

The bill, which extends Chapter 369 of the Kentucky Revised Statutes, would mandate collection of the complete name, mailing address, and e-mail address of all visitors who post Internet content. Web sites would have to display names next to all relevant content and establish procedures that enable anyone to obtain the rest of the information. The bill stipulates that mailing address and e-mail address only have to be supplied to supplicants in cases where someone has posted "false or defamatory" information.

Case law has unambiguously established that state regulation of the Internet constitutes a violation of the Commerce Clause. Couch's proposal also likely falls afoul of the Constitutionally-guaranteed right to freedom of speech. If passed, Couch's proposal would be doomed to a swift demise in the courts. In addition to serious legal obstacles, Couch's bill would also face insurmountable implementation challenges. Web site operators have no means with which to validate the identification information they receive from users or guarantee its accuracy. If it were even legally permissible, a state-wide ban on anonymous posting would have little impact because it would not be enforceable against web sites outside of the state of Kentucky. Indeed, such a law would likely compel site operators to move their web sites out of Kentucky.

Finally, the proposal itself is ideologically antithetical to American culture and values. Anonymous publication is a time-honored tradition that has figured prominently in America's literary and political landscape. Early American political philosophy was heavily influenced by Thomas Paine's anonymous pamphlet Common Sense, and by Cato's Letters, which were anonymously published by British writers John Trenchard and Thomas Gordon. Some of America's greatest literary works have also been published under pseudonymsfor instance the works of Mark Twain, who we know today as Samuel Clemens.

Couchwho says that he has been the victim of anonymous Internet criticism himselfacknowledges that the bill is probably unconstitutional and claims that his goal is to draw attention to Internet bullying, which he says is a serious concern for many young people in his district. He does not intend to rally support for the proposal. "I think right now (online posting) is pretty much just on its own. It's a machine that's going to go its own way," Couch told the Lexington Herald-Leader. "The state can try to pass some rules, but I don't really think it would do anything."

Proposing an inane, unconstitutional, and unenforceable law seems like a poor way to raise awareness of an issue. It looks like Couch needs some remedial education in civics and constitutional law, and I'm sure plenty of anonymous critics on the Internet will have similar opinions to share.

Boyfriend Charged In Kansas Stuck-On-Toilet Case

NESS CITY, Kan. (AP) A man whose girlfriend authorities say spent nearly two years in a bathroom in their house, sitting on the toilet so long that the seat adhered to her body, has been charged with mistreatment of a dependent adult.

Kory McFarren, 37, was charged Monday in Ness County District Court.

McFarren called the Ness County Sheriff's Office in late February to say something was wrong with his girlfriend. When authorities arrived at the home, they found Pam Babcock, 35, stuck to the toilet, which they think she had sat on for about a month.

McFarren told authorities that Babcock feared leaving the bathroom and may not have left it in two years, although said he was unsure how long she was in there. He said that he took her food and water daily, and that he repeatedly asked her to come out but that she usually replied "maybe tomorrow."

"The only thing I am guilty of is I didn't get her help sooner," McFarren told The Associated Press nearly a week ago.

Ness County Attorney Craig Crosswhite said the mistreatment charge most closely fit the situation.

"I looked at the statutes and spoke to the attorney general's office," he said. "This was a very unusual set of circumstances, and this is the law that most closely applied to the situation."

Authorities said Babcock sat on the toilet so long that open sores developed and caused her to become attached to the seat. Sheriff Bryan Whipple has said that he used a pry bar to remove the seat from the toilet, and that the woman was taken to the hospital with the seat still attached.

"She would have to be sleeping on the toilet," Whipple said.

Doctors at a Wichita hospital where Babcock was taken told McFarren that an infection in her legs had damaged her nerves and could leave her in a wheelchair. She was still at the hospital Wednesday night.

McFarren's first court appearance will be in April, Crosswhite said.

Boyfriend of woman stuck to toilet gets probation

NESS CITY, Kan. - A man whose girlfriend sat on a toilet for so long that the seat adhered to her body will spend six months on probation.

Kory McFarren pleaded no contest last month to a misdemeanor count of mistreatment of a dependent adult. A judge sentenced him Tuesday to six months in jail but granted the probation after the victim, Pam Babcock, asked for leniency.

"She didn't believe that her circumstances were his fault," Ness County Attorney Craig Crosswhite said.

Babcock's plight became known in February when McFarren called the Ness County sheriff, expressing concern about his live-in girlfriend. When authorities arrived, they found Babcock physically stuck to the toilet.

McFarren told police Babcock had refused to come out of the bathroom for two years. Medical personnel estimated she'd been sitting on the toilet for at least a month and said the seat had adhered to sores on her body.

She is now under the protection of a guardian who was appointed through the legal department at the hospital where she received treatment.

Also Tuesday, McFarren was sentenced to six months in jail for an unrelated charge of lewd and lascivious behavior for exposing himself to a teenage neighbor in March.
